Introduction

Fruit Of The Forest Woodworking LLC, which in this document will be referred to henceforth as FotF Woodworking, is dedicated to providing a superb experience to all clients and individuals who come into contact with us. We are dedicated to giving you an honest, unbiased, and professional experience, where we will do our best to take care of your needs and desires for your project. The following terms and conditions are spelled out to you, so that you can understand how we do and handle business. We vow to never violate these terms and conditions, and expect the same from you. We are dedicated to leaving the door open between you, our client, and us. If you have any questions, comments, or concerns, we will be happy to have an open dialogue with you about them. Whenever you do business with us, you agree to these terms and conditions, as do we when we do business with you.

Our rights to refuse service

While we wish to take on every client who comes to us, we do have some reservations. Given the artistic nature of our work, our artists and craftsmen and women may not be able to produce what you are envisioning. As a general rule of thumb, we are dedicated to serving our employees first, and will not require them to partake in the creation of artistic representations, furniture, artwork, carvings, or otherwise, that they are not comfortable with. It is our policy that any pieces we do not feel comfortable producing, we will politely decline and do our best to point you in a better direction, if we know of any. 

FotF Woodworking’s facilities house a wide range of industrial woodworking equipment, and we are capable of creating a wide range of furniture, decor, and artistic pieces, but we reserve the right to refuse pieces that we believe we would not be the best fit for. We will never take on a project that we are not confident that we can complete, and given the highly complex nature of woodworking, it is impossible for us to give a definitive list of everything that we can and cannot produce. If we are unable to produce what you are envisioning, we will politely decline and notify you if we know of any better suppliers to meet your needs. 

Regarding Payments and Pricing

Our pricing model will vary from piece to piece. Factors such as wood species, grain selection, timelines, and the complexity of the actual piece all play a factor into how expensive a piece will be. We do our best to price our pieces fairly and accurately. We do not believe in marking up our prices just because we can. When you spend extra money on something we produce, we believe that you should be getting something extra as well. More money means more product. We understand that you may find hardwood lumber that is cheaper than some of our suppliers. You may even be tempted to request we use your alternatively sourced lumber. Hardwood lumber comes in a very wide selection of grades and qualities. For example, oak boards you buy at one supplier can be completely different from oak boards purchased at another supplier. Wood in Arizona is generally more expensive than wood in other states, because not only does most hardwood not grow in Arizona, but the process for bringing it into the state is a long and delicate one. Arizona’s climate is extremely dry and many hardwoods do not survive the sudden shock of the change in climate. We are dedicated to only building furniture with wood that has been properly sourced and acclimated to our climate. If you request for us to build a piece from lumber that you supply, we cannot guarantee that we will be able to use the lumber you have supplied without very careful consideration. 

Deposits and payments

By engaging with FotF Woodworking, you agree to the following terms and conditions regarding deposits and payments. 

All deposits are non-waivable, meaning we will not move forward with work on your piece under any circumstance unless you have paid them and the payment has cleared into our account. Failure to pay a deposit within 1(ONE) week of the request for the deposit to be made may incur the following: if in the quote or design stage, we may have to recalculate the price before moving forward. If in the construction or installation phase of your project, by failing to pay the required deposits, you are subject to the detailed conditions defined in their respective clauses below. An open dialogue may remain for you to resume working with us, should you wish to move forward with your piece again, but this is a decision that FotF Woodworking has the final say on. As a general rule of thumb, we will do our best to accommodate your needs and desires, but we must also enforce healthy business boundaries for the sake of every party involved. We only receive legal methods of payment, and any illegal methods of payment will be reported to the relevant authorities. If you pay us with counterfeit, laundered, or otherwise illegal cash, assets, and other relevant payment methods, you assume full responsibility for any and all damages incurred to FotF Woodworking by your actions. 

Mandatory 5% deposit before design process

By requesting a design, you agree to the following

Before moving forward with the design of your piece, we require a 5% deposit of the initial quote we gave you. This is non refundable and will cover the work between the quote and finished design process. Should you choose to not move forward with us, you may not take our design and bring it to 3rd party suppliers to have them build it. Should you do so without our permission, you will be subject to fines and potential legal action, as designs by FotF Woodworking are intellectual property of FotF Woodworking. If you request to have FotF Woodworking give you a design so that you may have another party or yourself build it, then FotF Woodworking has the final say on whether or not that is allowed, and may charge an additional fee for the right to use the design in said manner. We are not a design company at FotF Woodworking, so while this may be something that can be requested, it should be noted that this is behavior that is out of the ordinary.

Mandatory 50% deposit before construction begins

In the process of designing the piece, we will develop multiple designs, each with their own specific price. These prices will likely vary from your initial quote, but we promise to keep them as close as possible to the quote we gave you. Once you have settled on a design, before we begin construction you are required to pay 50% of the final price as a deposit, minus the original 5% deposit you have already paid. For example, if we quote you for a piece that we estimate will cost $2000, your 5% deposit will be $100. After the design process, if the final price for your piece is actually $1800, then your 50% deposit would be $900, but what you will actually pay is $800, because you have already paid $100 upfront. For your ease, we will calculate the required amounts of each payment that you will be required to make. This explanation is simply for your clarity and our transparency. Should you choose to not move forward with us after you have given us the 50% deposit and before we have purchased the materials for your project, we will issue you an 80% refund of what you have paid. If a refund is requested after we have purchased the materials, we will take the amount you have paid us, subtract 20% and the cost of materials, and return the remaining balance to you, unless our suppliers are able to accept a return for the materials we have purchased from them. In which case where a return of the materials is possible, we will give you an 80% refund.  If you choose not to move forward with your project with us after we have already begun altering the materials and working on your project, then no refund can be made to you, and you willingly surrender both your payments and all materials pertaining to the project to FotF Woodworking. 

Final Payment

Final Payment is due when or before your piece is delivered/installed, with no grace period. Discounts are not available unless we were unable to provide to you what we originally agreed upon in the contract for your project. Failure to pay the full amount of the final payment will result in the piece being surrendered to FotF Woodworking with no refunds or compensation available. Once this takes place, FotF Woodworking is free to do as we please with the piece. If we are on your property and the piece has been placed on your property, it remains property of FotF Woodworking until the moment the final payment has been made, and only once the final payment has been made is it considered transferred into the ownership of the payee. It should be noted that we will never surprise you with the delivery of your piece unexpectedly. We will always contact you in advance, and we will only deliver your piece once you are ready, but please understand that we do not have the facilities to store your piece for prolonged periods of time, and if necessary we will discuss the possibility of storage charges on completed pieces held for longer than 3 weeks. Pieces will be considered abandoned and therefore surrendered to FotF Woodworking with no refund or compensation if you cease communication with us and do not respond after 7 attempts to reestablish communication with you, and 3 weeks have passed since the last point of contact with you.

Sales Tax

For our business classification, the state of Arizona requires that we collect sales tax on all sales made by us. This tax will vary depending on the time of year, specific piece you are purchasing, and if you are purchasing in or out of state from us. We will outline how much sales tax is due on each piece, but please note that in our initial quote, we are only able to provide you with an estimate for the sales tax we are required to collect, and not an exact figure.

Contracts and change orders

Every piece that FotF Woodworking builds must be built under a contractual agreement signed by both the representative party from FotF Woodworking and the client commissioning the piece. This contract will be offered by FotF Woodworking once a design has been selected by the client. This contract is only allowed to be amended by FotF Woodworking. FotF Woodworking will only build what has been outlined in the contract, which shall be as clear and detailed as humanely possible. If you wish to make changes to your contract or piece then you must submit a written request to us. We will draft a change order for you to sign and approve of. If you do not sign the change order, we cannot move forward with your request. Furthermore, changes to the design will require us to sometimes recalculate the final price of your piece. As a final note, we reserve the right to refuse change orders and instead move forward with the original design per the original contract, however we will always do our best to accommodate your wishes and the change orders you are requesting. We will never take on a project or change to a project that we are not confident we cannot accomplish. However, if unexpected circumstances cause us to be unable to follow through with what we agreed to, we will discuss possible refunds, discounts, and alternative timelines with you as applicable. As always, our goal is that you walk away from every interaction with us satisfied and happy with our work for you. 

Timelines for your project

Although we do have a general idea of the time it will take to build many of the projects that come through our doors, it should be noted that what we produce is art, and art you cannot rush. We will do our best to accommodate your timelines, but please note unless one is specified, your project will be completed when we are satisfied with what’s leaving our workshop is really our best work. Requests for a project to be completed under a specific timeframe may incur higher costs, and may not always be a service we can offer, and should be specified in the original quote. Our highest priority is that what leaves through our doors is a timeless piece of artwork that will last generations and leave us a legacy we can be proud of. We will always strive to accomplish this in a timely manner that does not sacrifice the quality of our work. 

Minors and individuals under the age of 18

FotF Woodworking does not do business with individuals under the age of 18 years of age, unless with consent from their legal parent(s) or guardian(s). Our employees will not enter a premise where a minor is present with no parent or legal guardian present. Minors may receive and pay for products from FotF Woodworking with parent or guardian consent and without their presence, so long as it does not require FotF Woodworking employees to enter the home or inside space of the dropoff location.

Treatment of our employees

While we don’t expect this section of our Terms and Conditions to be applicable to any of you, we want to make it known that our employees safety and respect is the highest priority to us. We ask that you treat every member and employee of FotF Woodworking with respect and dignity. Clients who do not treat us with respect will be blacklisted from our services. If we are in the process of completing a project for a client and they become hostile towards us, we will do our best to complete the piece without jeopardizing the safety of our employees, but we will take active measures against this hostility. If any of our employee’s safety comes into question, the appropriate authorities will be notified and the client will be immediately blacklisted from our services and receive no refund from us, unless an approved 3rd party representative is able to provide payment for and receive their finished piece on their behalf.

Illegal Activities

Any attempt to use FotF Woodworking in any way to facilitate illegal activities of any kind is strictly against our Terms and Conditions. Any individual or entity who causes damage to FotF Woodworking by using FotF Woodworking in this way is legally and wholly responsible for compensating FotF Woodworking for all damages caused. Failure to comply with this will result in legal action.

By accessing this website you agree to our privacy policy, which can be found in our privacy policy page. This page details what we do with your information and how we choose to store it.

Our Data and Information

FotF Woodworking, its intellectual property, and private information, is solely belonging to FotF Woodworking, Is not for sale, and is not available for public use. The names, personal contact information, details, and home addresses of our employees is not public information, and sharing, selling, or attempting to acquire this information may incur fines starting at $1,000 per violation, as well as legal consequences. Employees may choose to share their names and personal contact information at their own discretion, and clients are allowed to ask for it, but otherwise non-clients and those attempting to gather this information for non business activities or business activities that FotF Woodworking has not consented to is against our company policy and our terms and conditions.
